Terms of Service
Sara Chagas Fine Arts
Last updated: October 2026
1. Introduction
Welcome to Sara Chagas Fine Arts. This website is operated by Sara Chagas, an independent artist based in the United Kingdom.
Throughout these Terms of Service, the terms “we”, “us”, and “our” refer to Sara Chagas Fine Arts, and “you” refers to any visitor or customer using this website.
By accessing our website or placing an order, you agree to these terms. Please read them carefully before making a purchase.
These terms do not affect any rights you may have under applicable consumer protection laws.
2. Our Products
Sara Chagas Fine Arts offers original artworks, art prints, and, where available, custom artwork and commissions.
Original artworks are unique pieces. Prints may be produced on demand through our fulfilment partner, Printful.
We make reasonable efforts to ensure that product descriptions, images, dimensions, and prices are accurate. However, colours may appear slightly different depending on your screen settings, lighting, and the printing process.
Product availability may change, and we reserve the right to update product descriptions or discontinue products where necessary.
3. Orders and Acceptance
When you place an order through our website, you are submitting a request to purchase the selected product.
An order confirmation acknowledges that your order has been received. Where applicable, acceptance of your order will be communicated separately or indicated when the order is confirmed for fulfilment.
We reserve the right to cancel an order where there is a genuine reason to do so, such as a product becoming unavailable, a pricing error, or a suspected fraudulent transaction. If payment has already been taken, an appropriate refund will be arranged.
4. Prices and Payments
All prices and applicable delivery charges will be displayed at checkout before you complete your purchase.
The currency used will be indicated on the website or at checkout. Any additional charges, including applicable taxes, customs duties, or import fees, will depend on the order and destination.
Payments are processed through the payment methods made available at checkout. Orders will normally enter processing after payment has been authorised.
5. Production and Fulfilment
Some products are made to order and produced by our third-party fulfilment partner, Printful.
Production begins after an order is placed and may take additional time before dispatch. Processing and delivery estimates are indicative and may vary according to the product, destination, carrier, and seasonal demand.
Original artworks and commissioned pieces may have separate preparation and delivery arrangements.
For further information, please refer to our Shipping Policy.
6. Shipping and Delivery
We aim to dispatch orders and provide delivery information within the estimated timeframes communicated at checkout or in our order updates.
We cannot guarantee delivery dates where delays arise from postal services, customs procedures, adverse weather, or other circumstances outside our reasonable control.
Customers are responsible for providing accurate delivery information. If you identify an error, please contact us as soon as possible. Changes cannot be guaranteed once production or dispatch has begun.
Nothing in these terms excludes any rights or remedies available to you under applicable consumer law.
7. Returns, Cancellations and Refunds
Our Returns and Refunds Policy explains how cancellations, returns, replacements, and refunds are handled.
Your statutory rights remain unaffected. In particular, faulty, damaged, or misdescribed products may entitle you to a repair, replacement, or refund under applicable law.
Certain exceptions may apply to goods made to your specifications or clearly personalised items. Products being made to order does not, by itself, remove every statutory cancellation right.
Please read our Refund Policy before purchasing.
8. Custom Artwork and Commissions
Where custom artwork or commissions are offered, the agreed scope, size, materials, price, payment arrangements, and estimated completion time should be confirmed before work begins.
Customers are responsible for reviewing and approving the agreed requirements.
Because commissioned artwork is created individually, changes requested after work has started may affect the price and completion time. Any additional charges or revised arrangements will be discussed with the customer.
The legal rights applicable to personalised goods and commissioned services will continue to apply.
9. Intellectual Property
All original artwork, designs, photographs, written content, and other creative materials displayed on this website belong to Sara Chagas unless otherwise stated.
Purchasing an original artwork or print does not transfer copyright or grant permission to reproduce, distribute, modify, or commercially exploit the artwork.
You may not reproduce, copy, publish, sell, or use our creative content commercially without prior written permission, except where permitted by law.
10. Website Use
You agree to use this website lawfully and not to engage in fraudulent activity, interfere with website security, attempt unauthorised access, or misuse any content or services.
We may update, suspend, or modify parts of the website when reasonably necessary for maintenance, security, or business operations.
We aim to keep the website accurate and available but cannot guarantee uninterrupted access or that every feature will always operate without error.
11. Third-Party Services
Our website may rely on third-party services for website hosting, payment processing, product fulfilment, delivery, and other functions.
These services may operate under their own terms and privacy policies. We are not responsible for independent third-party services beyond the responsibilities imposed on us by applicable law.
12. Limitation of Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
Subject to the above, we are not responsible for losses that could not reasonably have been anticipated or for circumstances beyond our reasonable control.
Your statutory consumer rights remain unaffected.
13. Privacy and Cookies
We handle personal information in accordance with our Privacy Policy and use cookies and similar technologies as described in our Cookie Policy.
Please review these policies to understand how information is collected, used, and protected.
14. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our products, website, business operations, or legal requirements.
The latest version will be published on this page, together with the date of the most recent update. Changes will not remove rights that you already have under applicable law.
15. Governing Law
These terms are governed by the laws of England and Wales, where applicable. This does not remove any mandatory consumer protections that apply to customers in other jurisdictions.
